Who we are

Earlywaker is run by Tiago Miguel Gomes de Oliveira, a sole trader registered in Portugal (VAT number PT254510531), Rua Futebol Clube Pinheirense 129, Fundo Pinheiro, 3720-475 Pinheiro da Bemposta, Portugal. We are responsible for the personal data described in this policy.

For anything about your data, write to hello@earlywaker.com. We reply within 48 hours.

The short version

• The Earlywaker app has no accounts. Your alarms, streaks and settings stay on your phone.
• When you buy a Waker, we use your details to deliver it, invoice you and help you if something goes wrong.
• We don't sell your data. We only use advertising cookies if you accept them.

The Earlywaker app

You don't need an account to use the app. Your alarms, the times you woke up, your streak, your badges and your settings are stored only on your phone. We don't receive them. If you delete the app, they are deleted.

NFC. The app uses your phone's NFC reader only to check that the tag you scan is a Waker. It reads the tag; it doesn't read any other card or send what it reads to us.

Notifications and alarms. The app asks for permission to show notifications and to ring alarms. These permissions are used only to wake you up.

Your streak image. The app can create an image of your streak for you to share. It never reads your photos. If you choose to save the image, your phone may ask for permission to add it to your photo library.

The app doesn't ask for your email or any other personal details. It doesn't access your location, contacts, camera or microphone, it doesn't use analytics or tracking tools, and it doesn't show ads.

Our website and shop

When you buy from us, we collect your name, email, delivery and billing address, phone number if you give it, the products you ordered and your order history. We use them to:

• process and deliver your order and handle returns (necessary to perform our contract with you);
• issue invoices and keep accounting records (required by Portuguese tax law);
• answer your messages (our legitimate interest in helping you);
• send you news, only if you signed up (your consent).

We never see your full card details. Payments are processed by our payment providers.

Cookies

Our shop uses cookies that are needed for it to work, such as your cart and checkout. With your consent, we also use analytics and advertising cookies, including the Meta pixel, to measure our ads. You choose in the cookie banner and can change your choice at any time from the link at the bottom of the site.

Who we share data with

We only share what each service needs to do its job:

• Shopify, which runs our shop and stores order data;
• payment providers (Shopify Payments, PayPal) to process your payment;
• CTT and other carriers, which receive your name and address to deliver your order;
• our invoicing software, to issue invoices, which are also sent to the Portuguese tax authority as the law requires;
• Zoho, our email provider, when you write to us;
• Meta (Facebook and Instagram), only if you accepted advertising cookies.

Some of these companies may process data outside the European Union, for example in the United States. When they do, they use the safeguards required by EU law, such as the European Commission's standard contractual clauses or the EU–US Data Privacy Framework.

How long we keep your data

• Invoices and accounting records: 10 years, as Portuguese tax law requires.
• Other order and support data: up to 3 years after your last order or message.
• Mailing list: until you unsubscribe.
• App data: on your phone only, until you delete the app.

Your rights

You can ask us to see, correct, delete or move your personal data, to limit how we use it, or to object to its use. Where we rely on your consent, you can withdraw it at any time. Write to hello@earlywaker.com.

If you're not happy with how we handled your data, you can complain to the Portuguese data protection authority, CNPD (www.cnpd.pt), or to the authority in your EU country.

Children

Our shop is for people aged 18 and over. The app is not directed at children under 16.

Changes to this policy

If we change this policy, we will update the date at the top of this page.
